What is happening now?
Use the most recent notice. A fine notice, reminder notice, overdue fine and court document involve different choices.
Six NSW rules worth knowing.
These are starting points, not guaranteed outcomes. Read the current notice and official criteria before choosing a pathway.
Apply before the due date.
Revenue NSW says to request a review before the notice due date to avoid extra costs or action. The fine is put on hold while the review is decided.
A caution may be available.
Some lower-risk offences may qualify where a person has held a NSW licence for 10 years with a clear record. Serious and excluded offences do not.
Name the responsible person.
If you were not driving or sold the vehicle before the offence, use the nomination process. Providing false information is an offence.
Election changes the pathway.
Once accepted, a court election cannot be withdrawn. The court may impose costs, a higher fine, a conviction or licence disqualification.
Payment is not the only option.
Depending on eligibility, options include a payment plan, a 50% reduction, write-off or a Work and Development Order.
Enforcement can escalate.
Recovery can include licence or vehicle restrictions, garnishee action, Sheriff seizure, court examination or an interest in land.
